Discipline
CSU-AAUP represents all our bargaining unit members in cases that might result in discipline. We talk to members who have been informed of potential discipline, research the facts around the allegation, accompany members to meetings with management, attempt to work out solutions to problems, and even represent them in formal mediation and termination hearings.
Discipline of CSU-AAUP members is covered by Article 16 of our Contract.
Discipline may be imposed if a member violates an institutional or CSCU policy. Some of the key policies are:
- Acceptable & Responsible Use of IT & Resources
- Consensual Relationships Policy
- Sexual Misconduct Policy (Including Sexual Harassment)
- Violence-Free Campus Policy
Discipline can take many forms, up to and including termination. However, termination of tenured faculty members is only possible for adequate cause, i.e. if management can provide “clear and convincing evidence of unfitness of the affected member to discharge professional responsibilities.” There also are established procedures that must be followed outlined in the Contract.
If you are asked to a meeting by the Office of Human Resources or any member of management, and you think it could result in discipline, contact your campus AAUP president or grievance committee immediately, or our CSU-AAUP Contract & Compliance coordinator, Gary Winfield, at gwinfield@csuaaup.org.
Be aware of your “Weingarten Rights,” which include the right to Union representation during any investigatory interview when an employer seeks to obtain information which could be used as a basis for discipline or asks an employee to defend his/her conduct. Your campus AAUP will arrange for a member to accompany you to such a meeting.
